Law Enforcement Requests
These guidelines are for public authorities seeking information from The Corner Factory SA concerning the Up4it Platform. They do not create rights to data and do not replace applicable legal process.
Member privacy requests should follow Data Subject Rights. Private civil litigants must use the legally available procedure in the competent jurisdiction.
1. Contact
Section titled “1. Contact”Send requests from an official authority email address to support@the-corner.io with the subject Authority request.
The Corner Factory SA, Rue de St-Guérin 6, 1950 Sion, Switzerland. UID: CHE-271.016.257.
Email is not monitored as an emergency-dispatch service. In an imminent emergency, use the competent Swiss and international emergency-cooperation channels in addition to contacting us.
2. Legal Basis and Jurisdiction
Section titled “2. Legal Basis and Jurisdiction”Up4it reviews each request for authenticity, authority, jurisdiction, necessity, proportionality, and compliance with applicable law. We disclose personal data only where a valid legal basis permits or requires it.
Foreign authorities may need to use mutual legal assistance, police-cooperation, or other government-to-government channels. The correct route depends on the requesting authority, offence, urgency, data sought, and applicable treaty or law. Informal contact does not by itself require Up4it to disclose data.
3. Required Information
Section titled “3. Required Information”A request should include:
- the authority, responsible officer, official email address, telephone number, and badge or reference number;
- the legal authority and jurisdiction for the request;
- a signed order, warrant, production request, or other supporting process where required;
- the specific account, email address, Content, Moment, or other identifier concerned;
- the exact data categories and relevant date range;
- the offence or legal matter under investigation and the connection to the requested data;
- any non-disclosure requirement and its legal basis; and
- a requested response date, with reasons for urgency.
Requests that are vague, disproportionate, technically impossible, or insufficiently supported may be rejected or narrowed.
4. Preservation Requests
Section titled “4. Preservation Requests”An authority may request preservation of specifically identified data pending valid legal process. The request must identify the account or Content, data categories, date range, legal basis, and anticipated process. Preservation does not guarantee that data exists, extend ordinary collection, or authorize disclosure.
We preserve available data for a reasonable and lawful period and may require an extension supported by appropriate process.
5. Emergency Requests
Section titled “5. Emergency Requests”Where there is a good-faith belief of an imminent risk of death or serious physical injury, provide:
- a description of the emergency and why the risk is imminent;
- the person at risk;
- the specific data requested and how it could avert the harm;
- the Up4it account or Content concerned; and
- confirmation that the requester is authorized to make the emergency request.
We may disclose limited information where applicable law permits and the circumstances justify it. An emergency request is assessed case by case and is not a substitute for legal process.
6. Member Notice
Section titled “6. Member Notice”Up4it may notify an affected Member before or after disclosure unless notice is legally prohibited, would create a material safety risk, would prejudice an investigation, or another lawful reason justifies delay. We may challenge or seek clarification of an overbroad or unlawful non-disclosure demand.
7. Data Availability and Confidentiality
Section titled “7. Data Availability and Confidentiality”The data available depends on the features used, Member choices, and our Privacy Policy and retention practices. Up4it cannot provide data it does not have and does not create new records in response to a request.
Authorities should protect disclosed data and use it only for the lawful purpose for which it was obtained. Up4it may seek reimbursement of legally recoverable costs for unusually burdensome requests.
