Extenuating Circumstances Policy
This Policy explains how Up4it considers a serious event outside a Member’s reasonable control when reviewing a cancellation or alleged policy violation. Because Up4it does not process payments, this Policy does not create an Up4it refund or reimbursement right.
1. Relevant Circumstances
Section titled “1. Relevant Circumstances”Examples may include:
- a natural disaster or official emergency affecting the activity;
- a government order, closure, evacuation, or travel restriction;
- sudden serious illness, injury, or death affecting a Member or close family member;
- an unexpected transport failure that makes attendance impracticable;
- a credible and specific safety threat; or
- another event that could not reasonably have been prevented and materially affects the Moment.
Ordinary changes of preference, avoidable scheduling conflicts, or circumstances known before committing are generally not extenuating, but Members should still prioritize safety.
2. What to Do
Section titled “2. What to Do”Cancel or update the Moment as soon as reasonably possible and tell affected Members. If an Up4it enforcement review is involved, explain the event and provide only the minimum supporting information reasonably needed.
Do not send full medical records, identity documents, or sensitive third-party information unless we specifically request a secure and lawful method. We may accept a redacted confirmation or other proportionate evidence where verification is necessary.
3. Review
Section titled “3. Review”Up4it considers timing, foreseeability, the Member’s reasonable precautions, safety, available evidence, impact on others, and any pattern of misuse. We may remove or reduce an account measure where an event reasonably explains the conduct.
Decisions can be appealed under the Reporting and Appeals Policy. A commercial Organizer’s legal or contractual duties to Participants remain unaffected.
4. External Payments and Costs
Section titled “4. External Payments and Costs”Any refund or cost claim must be addressed to the person or provider that accepted payment. See Participant Refund Information. Up4it does not reimburse travel, tickets, accommodation, lost income, or other external costs.
